The Politics of Advertising and Campaign Finance

The current presidential campaign is expected to be the most expensive ever, with hundreds of millions of dollars (the Bush and Kerry campaigns alone have raised more than $500 million) being spent to persuade the electorate. Of the millions of dollars being spent, a great deal is being focused on television advertising. The groups that pour their money into this electronic battle come from every political strip, and they are spending vast sums of money to sway the election.

Aside from John Kerry? campaign and George W. Bush? campaign, enormous amounts of money are being spent. After the McCain-Feingold bill became law, stricter spending limits went into place. However, there have been some groups that have quite effectively circumvented the law? requirements, operating under a newly created tax status in one case and exploiting another to full advantage in another.

The first, and most publicized set, is known by the media as 527s, so named because that is the tax code under which they operate. When John Kerry? campaign experienced a financial crunch, his democratic 527 counterparts ably took up the slack, campaigning in every state in which the electorate might be swayed to send its electoral votes his way; likewise, Swift Boat Veterans for Truth are a 527 organization that attacked Kerry? service in Vietnam and his actions after returning home. Shortly after the ads began receiving wide-spread recognition, polls indicated that Kerry? numbers were slipping, arguably demonstrating that the group? television advertising had been effective.

527 groups are not allowed to coordinate with the campaigns of the candidate they hope to help elect, but they wield a great deal of clout as their donations are not monitored as those of the parties?or their candidates.?One group alone, The Media Fund, spent at least $35 million through August. The expenditures of these groups might soon be curbed, however. A bill was recently introduced to Congress that would require them to register as political committees with the Federal Election Commission (FEC), with the exception that those that raise and spend funds solely relating to nonfederal candidate elections, state and local ballot initiatives, or nominations/confirmation of individuals to non-elected offices, would not be required to register.

Another group who is changing the post-McCain-Feingold landscape is comprised of organizations known as 501c?. These are not regulated by the FEC but by the Internal Revenue Service (IRS). While 501c (3) groups are prohibited from participating in partisan politics, 501c (4,5, and 6) groups can participate so long as the expenditure is less than one-half of the organization? total budget. Because the stipulation is solely based on the overall budget of 501c organizations, unregulated (soft) money is now pouring onto the campaign landscape through them.

Since so many people watch television on a regular basis, television advertising could arguably be the most effective method for a candidate to spread his or her message, but it is increasingly more difficult to reach a wide audience. Due to the wide range of programming offered through cable television, political commercials often run in thousands of spots, meaning that some people may see a commercial far more times than they would like while their neighbors might not see the advertisement only rarely or not at all.
